1. Who provides the service

ArtDebutPrice (artdebutprice.com) is a service of Luyten Gallery, S.L. (Tax ID B21619937; C/ Arnald de Solsona 6, 1.º, 25005 Lleida, Spain; Lleida Commercial Registry, sheet L-36551; info@artdebutprice.com). ArtDebutPrice is a trade name, not a registered trademark.

2. What ArtDebutPrice is

A tool for an artist to debut a work of theirs: it creates a page with a debut price for 24, 48 or 72 hours and a later price, an image for their Instagram stories and the links to share it. ArtDebutPrice does not sell works, takes no part in the sale, charges no commission and does not receive or handle payment for the work. When someone taps “I want it”, they are taken to WhatsApp, to their email or to the work’s page in the artist’s shop. Any sale is solely between the artist and the buyer.

3. Account

You need an account to launch a debut. You sign in with Google, with a code sent by email or, if you create one, with a password. You must be of legal age. You are responsible for your details (artist name, Instagram username, “I want it” destinations) being yours and correct, and for keeping access to your email and password safe. Sessions last 180 days from last use; “Sign out” ends them.

4. Free debuts and packs

• Each account has one free debut per calendar month (UTC). It does not carry over.
• To debut more, you can buy packs of 5, 15 or 40 debuts for 10, 25 or 50 (euros, pounds or dollars, in your account’s currency), taxes included. Each pack is valid for 12 months from purchase. The month’s free debut is used first, then the pack that expires first.
• A debut is used when launched. A launched debut is not refunded, even if you end it early.
• Payments are processed by Stripe. Every purchase comes with an invoice. We do not store card details.
• Right of withdrawal: packs are digital content supplied immediately on payment. When buying, you expressly ask for immediate supply and acknowledge that you therefore lose your right of withdrawal (art. 103.m of Spanish Royal Legislative Decree 1/2007). Wrong or duplicate charges are refunded: write to info@artdebutprice.com.
• Debut pages always show the ArtDebutPrice brand and its seal, with or without a pack.
• We may change pack prices for future purchases; packs already bought do not change.

5. Debut rules

The system enforces these rules and you accept them when launching:

• Once launched, the debut price and end time are fixed: they cannot be lowered or extended. You can end it early.
• A work has only one debut.
• The later price can go up, never down.
• Debut guarantee: if someone writes to you through “I want it” before the countdown ends, you keep the debut price for them. This does not apply when “I want it” leads to your shop: the price your shop shows applies.

6. The artist’s commitment

Before launching, you accept a commitment that is published on the page as yours: 1. Not to extend or repeat that debut. 2. Not to offer that work at that price or less again, on ArtDebutPrice or anywhere else. 3. That, after the debut, the work’s price will be the stated later price, which can go up and never down. If the destination is your shop, you also commit to your shop showing the debut price until the end and the later price from then on. Breaching the commitment may lead to account suspension (section 9).

7. What the artist warrants

That the work is yours or you have the right to offer it; that you hold the rights to the photos you upload; that what you publish is true (title, medium, size, edition, prices) and lawful; and that you honour what you announce to the buyer, including the debut guarantee. You alone are responsible for the sale: price, delivery, shipping, taxes, invoices, warranties and returns towards the buyer.

8. Content and licence

Your photos and texts remain yours. While your content is published, you allow us to host it, show it on your page, use it to generate story images and the link card, and resize it. The ArtDebutPrice software, design and brand belong to Luyten Gallery, S.L.

9. Reports and suspension

Anyone can report a debut. With several reports from different addresses, a debut may be suspended automatically while it is reviewed. We may suspend debuts or accounts, or remove content, if they breach these terms, if the work is not the artist’s, or if it is fraudulent or unlawful. If we suspend by mistake, we reactivate it.

10. What we do not guarantee

We do not guarantee sales, visits or results. We are not a party to any sale and are not responsible for the authenticity, condition, ownership or delivery of works. We aim to keep the service running, but there may be interruptions; launched debuts are not lost (the server sets the end time). We rely on third-party services (Instagram, WhatsApp, Google, Stripe, email) and are not responsible for their changes. Nothing here limits the rights the law gives consumers.

11. Deleting your account

You can delete your account in “Account”. Your data, debuts and images are deleted. Unused packs are lost. Invoices are kept for as long as the law requires.

12. Changes

If we change these terms, we will announce it on the site and by email with reasonable notice. Changes do not affect debuts already launched or packs already bought.

13. Law and courts

These terms are governed by Spanish law. If you are a consumer, you may go to the courts of your place of residence. Contact and complaints: info@artdebutprice.com.
